Which US laws require it?

Texas H.B. 1181, enacted in 2023, requires commercial sites with a substantial share of sexual content to verify that visitors are 18 or older. In Free Speech Coalition v. Paxton, decided June 27, 2025, the Supreme Court applied intermediate scrutiny and upheld the law, clearing the way for similar statutes.

What are the privacy trade-offs?

ID upload gives the strongest assurance and the largest risk: a database of identity documents linked to adult-site visits. Several state laws forbid retaining the data after the check, but enforcement depends on the vendor. Third-party checks reduce what the site sees while moving the record to another company.
